Grant County Circuit Courts Overview

Indiana uses circuit courts, superior courts, and local city or town courts as trial courts. The Indiana Judicial Branch explains that trial-court labels in Indiana are often products of history and local practice, and that the actual work handled by each court can vary by county. In Grant County, the primary trial-court name resolves to Circuit and Superior Courts. The county-level system includes Grant Circuit Court, Grant Superior Court 1, Grant Superior Court 2, Grant Superior Court 3, Gas City City Court, Marion City Court, and a Juvenile Court magistrate role under Superior Court 2.

Grant County is in Judicial District 14 with Madison County. Appeals from Grant County state trial courts generally go to the Court of Appeals of Indiana unless the Indiana Supreme Court has direct jurisdiction or grants transfer. Grant County Court Table

Grant County court identifiers are useful when reading MyCase entries and case numbers. The "27" prefix is the county number used in local court codes. Local rules use those codes to route civil, criminal, juvenile, traffic, small-claims, probate, and city-court matters.

Circuit Courts vs City Courts

Grant County does not use a Texas-style county court or justice of the peace structure. The local lower courts named in the State Court Structure Map are Gas City City Court and Marion City Court. The comparison below follows Grant County's actual court structure and local routing rules.

Grant County Case Flow

Civil and criminal cases move through different Grant County routing rules. Civil assignments send mental-health cases to Circuit Court, tax-sale cases to Superior Court 1, protective order and adoption cases to Superior Court 2, IV-D support collection to Superior Court 2, small claims and evictions to Superior Court 3, estates to Superior Court 1, and guardianships involving incapacitated adults and minors to Superior Court 1. Several civil case types may be filed in Circuit, Superior 1, or Superior 2 at the filer's election unless assigned by rule.

Grant County Court Assignments

Grant Circuit Court receives juvenile waivers to adult court, cases designated Drug Court or Veterans Court, and grand-jury proceedings. Superior Court 1 receives tax-sale cases, estates, adult and minor guardianship cases, Reentry Court cases, and some felony random assignments. Superior Court 2 receives protective orders, adoption cases, IV-D support, juvenile JP/JC/JT/JM matters, all juvenile cases except waivers to adult court, and Family Recovery Court or CHINS-related matters. Superior Court 3 receives small claims, evictions, all Level 6 felony cases, and CM misdemeanor cases with an OWI charge under IC 9-30-5.

If a defendant already has a pending case or is on probation in Grant Circuit/Superior courts and a new felony is filed, the new felony goes to the court with the pending charge or probation. Otherwise, Level 5 and higher felonies and trial de novo cases from city courts are randomly assigned among Circuit Court and the three Superior Courts through Odyssey. Bankruptcy cases are federal and separate from Grant County civil filings, even when the person, property, or judgment has a local connection.

Grant County Court Building

The primary courthouse is the Grant County Courthouse / Grant County Courts at 101 E 4th St, Marion, IN 46952. The courts list office hours as 8:00 a.m. to 4:00 p.m., Monday through Friday, with a 12:00 p.m. to 1:00 p.m. closure. The Clerk is on the 1st Floor, phone (765) 668-8121, fax (765) 668-6541, email pharris@grantcounty.net. The prosecutor is also in the courthouse, Room 107. Court services include Grant Circuit Court, Grant Superior Courts 1, 2, and 3, juvenile court functions, marriage and child support, traffic/small claims, public defender page, and prosecutor page.

Security rules are unusually specific. Everyone entering the Grant County Courthouse or any location where a Grant Circuit or Superior Court judicial officer keeps an office or conducts proceedings must consent to a search of their person and any package, briefcase, or purse. Prohibited items include cameras, audiovisual recording devices, cell phones or similar communication devices unless a listed work-related exemption applies, body armor, explosives, firearms, knives, stun guns, tasers, pepper spray, and other items capable of causing serious bodily injury.

That federal division includes Grant County for federal district cases, but it does not replace the local Circuit and Superior Court case path.

Grant County Lower Courts

Gas City City Court and Marion City Court are the lower courts identified in the State Court Structure Map. Gas City City Court receives many CM misdemeanor and IF infraction cases outside Marion corporate limits, Gas City ordinance violations, some Marion-city-limit cases when the primary officer is the Sheriff's Department or Indiana State Police, and compulsory-school-attendance violation misdemeanors. Marion City Court receives Marion city-limit CM and IF cases not assigned to Gas City or Superior 3 and all Marion ordinance cases.

Marion City Court's page says the City Clerk provides City Court services, dockets and sets court dates for misdemeanors, infractions, and ordinance violations filed in City Court, receives payment for misdemeanors, traffic tickets, and ordinance violations, and returns City Court bond money. Court sessions include Monday and Thursday 1:30 p.m. arraignments and pretrials, Thursday 2:00 p.m. trials, and twice-monthly Thursday 1:00 p.m. ordinance-violation trials.

The federal inmate locator is for federal custody after federal proceedings, while Grant County jail and court case records remain separate local and state resources.
